Consent to Paperless Delivery of Notices and Documents

We are pleased to offer electronic delivery of notices and documents (“Paperless”). Eligible policies and/or billing accounts can be enrolled for this service.

By providing your consent below, you agree to receive certain notices and documents electronically instead of by mail. Enrollment in Paperless is voluntary and not a condition of purchase. If you do not consent, you will continue to receive paper documents.

By consenting to Paperless, you agree to:

  • Voluntary Enrollment: Enrolling in Paperless is optional.
  • Electronic Delivery: You agree to receive all available notices and documents related to your policies and/or billing accounts electronically. These may include, but are not limited to: policy declarations, endorsements, contracts, renewal offers, privacy statements, billing statements, and other policy-related communications (“Documents”). Some documents may still be delivered by mail due to legal or technical constraints, but most will also be available electronically through your account.
  • Access Requirements:
    • Valid email address
    • Internet access and an up-to-date browser
    • Adobe® Reader® software (available free at www.adobe.com)
    • An active Lavalier.com account
      If you wish to print Documents, you will also need access to a printer.
  • Document Availability: Documents will be available online for a limited time. We recommend saving or printing copies for your records.

Required Hardware and Software

  • Operating Systems: Windows® 10, MacOS® Catalina 10.15.x
  • Browsers: Mozilla Firefox 86+, Safari™ 14.0.x+, Chrome 89+, MS Edge 88+
  • PDF Reader: Acrobat® or similar software
  • Screen Resolution: 800 x 600 minimum
  • Security Settings: Allow per-session cookies
    These requirements may change. If they do, you will be asked to reconfirm your consent. Pre-release (beta) versions of operating systems and browsers are not supported.

Notifications

When Documents become available, we will email you either:

  • A secure link to your Lavalier.com account where you can view, download, and print Documents; or
  • A secure PDF version of your invoice and a link to view materials online.

You agree to receive email notifications related to renewal offers and policy communications, even if you have unsubscribed from marketing emails.


Your Responsibilities

  • Maintain a valid, current email address and update us promptly if it changes.
  • Ensure your email account can receive messages (e.g., sufficient storage, no blocking of our emails).
    If emails are undeliverable and no other active email address is associated with your account, we will assume you have withdrawn consent and revert to paper delivery.

Other Important Terms

  • You may update your email or revoke consent anytime via Lavalier.com, by email ([email protected]), or by phone (855-477-6687).
  • Revoking consent will stop electronic delivery and may remove any applicable discounts.
  • You can request paper copies of any document at no charge.
  • We may continue to send paper copies of certain documents if required by law or due to technical constraints.
  • We reserve the right to modify Paperless requirements or discontinue the service.

Important State Specific Disclosures and Consent Language for Paperless 

Specific disclosures and consent language may be required by certain states. Please read the disclosures or consent language below applicable to the state for which your policy is issued. 

Georgia: 

For policyholders of the state of Georgia who have elected to receive all mailings and communications electronically, you hereby also agree as follows: 

I AGREE TO RECEIVE ALL MAILINGS AND COMMUNICATIONS ELECTRONICALLY. SUCH ELECTRONIC MAILING OR COMMUNICATIONS MAY EVEN INCLUDE CANCELLATION OR NONRENEWAL NOTICES. 

Tennessee: 

The policyholder who elects to allow for selected policy Documents, available notices and communications to be sent to the electronic mail address provided by the policyholder should be aware that the election operates as consent by the policyholder for notices to be sent electronically, which may include notice of nonrenewal and cancellation. Therefore, the policyholder should be diligent in updating the electronic mail address provided to the insurer in the event that the address should change. 

New York: 

For policyholders of the state of New York who have elected to receive all mailings and communications electronically, you hereby also agree as follows:  

I AGREE TO RECEIVE ALL MAILINGS AND COMMUNICATIONS ELECTRONICALLY, INCLUDING BUT NOT LIMITED TO:  IDENTIFICATION CARDS, DECLARATIONS PAGE, POLICY,  POLICY ENDORSEMENTS,  IMPORTANT POLICY NOTICES, RENEWAL NOTICES,  BILLING STATEMENTS, BILLING NOTICES,  AND ANY OTHER BILLING DOCUMENTS AND POLICY DOCUMENTS AS DEFINED IN THE PAPERLESS TERMS AND CONDITIONS AGREEMENT.  

Information Storage Authorization

You authorize us or one of our vendors to store any information you provide, including, but not limited to, names, addresses, birth dates, Bank Account or Payment Card information.

You certify that you are the owner or authorized signer for any Bank Account or Payment Card you provide, and you authorize the financial institution where any such Bank Account or Payment Card is held to honor any withdrawals or charges you authorize.


Consent to Receive SMS/MMS/RCS Messages

We are pleased to offer SMS (Short Messaging Service), MMS (Multimedia Messaging Service), and RCS (Rich Communication Services) text messaging for important account and policy-related communications (“Service Messages”) and optional marketing updates (“Marketing Messages”). Messages may include rich media and interactive features when supported by your device and carrier.

Service Messages:

Active policyholders will automatically receive SMS/MMS messages related to their account and policy. These may include, but are not limited to:

  • Payment reminders (including missed or late payments)
  • Renewal notices
  • Coverage updates
  • Customer support communications

These messages help you manage your policy and are part of maintaining your account. You do not need to provide separate consent for these service-related messages. By maintaining an active policy, you acknowledge and agree to receive them.



Marketing Messages:

You may also choose to receive marketing-related messages (“Marketing Messages”), such as product updates, quotes, offers, and promotions. Enrollment in marketing messages is voluntary and not a condition of purchase. If you do not consent, you will continue to receive service-related messages only.


Message Frequency

Frequency varies based on account activity (e.g., billing cycles, missed payment alerts) and marketing preferences.


Costs

We do not charge for SMS/MMS/RCS messages. Standard carrier rates apply.


Privacy

Your mobile number and related data will only be used for delivering SMS/MMS/RCS messages and will not be sold or shared for marketing purposes. See our Privacy Policy for details.


Your Responsibilities

Opt-Out

You may revoke consent for any SMS/MMS/RCS messages at any time by replying STOP to any message or updating your consent in your Lavalier.com account. Compliance and Liability

Carriers are not liable for delayed or undelivered messages. Messages are sent using a registered 10DLC number in compliance with carrier and industry standards. We are not responsible for delays or failures caused by your carrier or third-party platforms.
